Policy Statement

It is important that you read all the information contained in this Policy Statement, so that you understand the terms, conditions and policies that govern the use of the CoffeeZone website. As always, your rights as a consumer will always be present, but you as a customer must acknowledge that we as the owner of this website must also develop and maintain rules and regulations to meet our legal and moral obligations. 

If at any time you wish to discuss any part of this website or the information within the Policy statement, then please call us on 02 9807-8633. It is also imperative that you read and understand all that is written here, before you order from the CoffeeZone website.

Acknowledgment & acceptance of terms and conditions

CoffeeZone and the CoffeeZone website are owned and operated by Zanbil Enterprises Pty Ltd (A.C.N 094 269 600, A.B.N 91 094 269 600), which is 100% Australian Owned and Operated. Using this website in any form, constitutes that you have read, understood and agree to all the terms, conditions, disclaimers, and policies. Using this website also constitutes that you understand all the terms and conditions as listed herein, and that you will contact Zanbil Enterprises Pty Ltd if you do not understand any part of this policy statement.

You as the customer will also agree that there will be changes to the terms, conditions, and policies regarding this website, and that these will be amended/changed as required to suit; the business, you the consumer, Government regulations and the current market. All amendments will become effective immediately unless otherwise stated, and your continued use of the CoffeeZone website constitutes that you agree to all and any amendments made.

Pricing and GST 

All CoffeeZone pricing is in Australian dollars unless otherwise stated. Pricing is subject to change without notice, however CoffeeZone will try and give all its' customers advance warning if possible. 

All coffee and tea is not subject to GST, however coffee/tea hampers are subject to GST under the current legislation, as is all equipment, accessories and services. GST will be indicated on all tax invoices and by law must be charged for the relevant items regardless of the payment method. All prices listed are inclusive of GST.

Recommended Retail Price (RRP) is usually the suggested retail price of the manufacturer or the standard price listed by most retail outlets, but not taking into account special pricing such as; special sales prices, discounting or any other pricing that is not the standard. Zanbil Enterprises Pty Ltd does not accept any responsibility, liability or blame for the accuracy of the RRP pricing listed on the CoffeeZone website, as this is purely a service to show consumers what the average RRP is for the individual items, which can also vary from retailer to retailer. 


Specials

The specials offered in the specials page are only available while stocks last. These are usually items that have been purchased at a much lower price than normal or discontinued items, and stocks are always limited. There is nothing wrong with these products, but from time to time the manufacturers will need to clear stock to boost cash flow, or just drop the price as an incentive to their customers. In turn CoffeeZone passes on the savings, which at times can be 70% off the RRP. All warranties are inclusive with these products, as are all your rights as a consumer.

Thus CoffeeZone tries to take advantage of this when possible and passes on the savings to you, our valuable customer. So therefore at times even though you have paid for and have received a receipt confirming your order, it is still possible that the "specials item is unavailable. If this happens then you will be contacted and an alternative solution will be arranged.


Customer Information

When you as a customer agree to all the terms, conditions and policies governing CoffeeZone and the use of the CoffeeZone website, you also agree to provide accurate information where and when required. You are also required to maintain and update this information when required. The Coffeezone website has a "Customer Accounts" section which allows you to update your information as it changes or when you deem it necessary to amend.

This is particularly important for delivery, contact and payment information and is the responsibility of you the customer to ensure that this is always up to date. Any deliveries made to wrong or unattended addresses, which are the fault of you, the customer, may incur a surcharge/handling fee. Thus by agreeing to the terms, conditions and policies, you also indemnify Zanbil Enterprises Pty Ltd and CoffeeZone from all damages, losses, expenses, and all other liability if your information is incorrect. However please note that your right as a consumer and Government regulations are part of these terms, conditions and policies.

You as the customer are liable for any transmission or attempted transmission of any material that contains; a virus or other harmful material. Any breech of this or other parts of the terms, conditions and policies constitute that you no longer agree with the terms, conditions and policies and your privileges as a customer will be waived. Any malicious actions on your behalf will be considered criminal acts against Zanbil Enterprises Pty Ltd and CoffeeZone, and thus prosecution within the boundaries of the law will be executed. 

You will also give full rights to Zanbil Enterprises Pty Ltd and CoffeeZone to disclose any relevant information to the appropriate Government and/or Law bodies in the case of legal action being taken against you for any unlawful behaviour, or for any other reason that is required by law. At all times your rights will be upheld by Zanbil Enterprises Pty Ltd and we as an entity shall be guided and governed by any legal requirements that bind us. 


General Policy

Only persons legally entitled to enter into binding agreements/contracts are qualified to purchase goods from the CoffeeZone website. This includes persons under the age of 18 years who are not legally able to enter in to a binding agreement/contract.

However this does not restrict all persons from using all other parts of the CoffeeZone website as intended and within the bounds of the terms, conditions and policies set.

It is also the responsibility of all persons using this website to act responsibly and adhere to the terms, conditions and policies relating to this website.


Purchasing of Goods and Services

Any purchase of goods or services from the CoffeeZone website must be done in adherence to all the terms, conditions and policies set out in this website and also in adherence to all Government legislation. 

An order placed by you to purchase a product or service means that you have read and understood all the terms, conditions and policies with regards to using the CoffeeZone website. Thus when you place an order you are entering in to an agreement to fulfil your obligations with regards to payment, providing accurate information and all other requirements of the website and Government legislation.

CoffeeZone has the right to refuse to supply you with product or service if any of the requirements are not met, and without limitation if; stock of items are unavailable at the time, at the time of ordering the product/service is no longer being offered, error in price structure or price calculation, and error in product or service description and specification. This and other issues may also limit CoffeeZone from either fulfilling your order in full or completing your total order. You will be notified and alternatives will be issued. An order will only be confirmed with a receipt sent to you via email or a follow up fax or phone call if required. 


Stock Availability

From time to time certain stock items may be unavailable due to unforseen circumstances, even though they are listed on the website. These items may just be temporarily out of stock or no longer available. If this happens you will be notified if and when your order goes through and an alternative solution will be found. You will not be charged for this item, however if you are, then you will be refunded as soon as practical.

Delivery

Our standard delivery is currently through the Australia Post service for parcels within Australia. All parcels to customers are registered so that we can determine if the parcel has been delivered correctly. However there will be times when we may need to use commercial couriers with no added cost to the customer. If for any reason there is a need to charge the customer an additional fee, this will be done with the customers consent first.

All deliveries are sent to the customers preferred delivery address. This can be a home address, a P.O.Box address, a work address or another convenient address. The address can change on a per order basis, all that we require is that your postal address stay updated. Please make sure that the delivery address is correct, particularly hard to find or confusing address locations. For remote locations please use the most convenient delivery address. In our experiences we have found that P.O.Box addresses to remote locations work best. For delivery to work/office locations specify the company name, customer name, building number and name (if available), level or floor, suite number (if applicable), department name, daytime or mobile phone number, work phone extension number and any other information that is required to get the parcel delivered to the proper destination.

When deliveries are made we expect that there should be someone available to receive the parcel, and if at a place of work please advise the receiving area that you are expecting a personal parcel so that they can advise you when it has arrived.
Parcels are usually delivered between 7 am and 7:30 pm depending on the location and method. However please note that these delivery times may vary on a day to day basis, as circumstances beyond our control may come in to play, thus we can not be held liable for such issues. Our only responsibility is to have your order to you within a maximum of 7 days, unless otherwise stated or agreed by you. The standard service is 3 days to major capital cities and metropolitan areas, however other areas can take up to 7 days. It is important that if you have not received your parcel within 7 days please contact CoffeeZone delivery department at delivery@coffeezone.com.au or phone CoffeeZone on 02 9807-8633.

International Delivery

International customers wanting to place orders can contact CoffeeZone for a delivery quote at sales@coffeezone.com.au

All prices are in Australian dollars and must be paid in the Australian currency. We can accept MasterCard, Visa Card and American Express as payment for all international orders.


Refunds

It is the policy of CoffeeZone that we will refund the cost of the product but not the delivery cost if the customer is not satisfied with the coffee or tea on a personal taste basis. We understand that people have different tastes in coffee and tea and what appeals to one person may not appeal to another, thus CoffeeZone has guaranteed to refund the cost of the coffee or tea but not the delivery charge. We only guarantee that our coffee and tea will be of the highest quality at all times and thus we will refund any purchase based on this.

CoffeeZone will fully refund any coffee and tea product that is not of the highest quality and faulty in anyway. This means any coffee or tea that is stale, burnt or bitter. However the customer needs to understand that if the coffee or tea is not stored correctly, ground correctly or brewed correctly, then this will all impact on the coffee or tea. Thus the responsibility lies with the customer in regard to this. Please refer to our brewing and storage tips or if you have any questions please contact CoffeeZone either by email or phone before returning coffee or tea to CoffeeZone.

CoffeeZone will only issue refunds for coffee and tea providing that only 10% of the product has been consumed and the refund claim must be made within 14 days from receiving the products. See the table below for an indication of when the 10% is translated in to grams and cups. The cups figure has been rounded to the nearest cup based on 7 grams per cup for coffee and 2 grams per cup for tea.

We at CoffeeZone believe that the 10% break will allow you and your family/friend to sample the coffee and tea to determine if you like the product enough to continue purchasing from CoffeeZone.

There will be no refunds on equipment/accessories after 14 days unless they are faulty. CoffeeZone will exchange any faulty equipment/accessories unless otherwise stated by the products' warranty. It is the responsibility of the customer to return the product to CoffeeZone, and it is recommended that the customer register the delivery of the item in case the delivery service misplaces the item. Any faults outside the warranty time period will need to be handled directly by the manufacturer as per original manufacturer warranty conditions. If the customer has any questions or issues relating to this, please contact CoffeeZone to discuss the matter further. Please take care in reading all manufacturer warranty conditions, as CoffeeZone has no control over manufacturer warranty and purchase conditions.

CoffeeZone will at all times help the customer resolve issues between the customer and the manufacturer, but customers must understand that CoffeeZone is merely reselling equipment/accessories and thus is controlled by the manufacturers warranty and conditions of sale.

Please note however that all consumers' rights are still protected under various government legislation and regulation.


Security 

All transactions on the CoffeeZone site are SSL at 128 bit encryption and verified, thus making the site secure to trade in. All credit card information and transactions will be handled as per the conditions set by the banks, credit card companies and Government regulations. You as a purchaser also have the responsibility not to use credit cards attained in a fraudulent manner and credit cards that do not meet the requirements of the issuing party and the regulations set by the Government.

CoffeeZone will hold you personally responsible for any unauthorised or illegal acts, and thus will take the relevant legal action against you if so required. 


Third Party Links, Advertisement and Joint Promotions

From time to time the CoffeeZone website may contain links, advertisements, and joint promotions with third parties. We accept no responsibility for the accuracy, ownership or information of the link or website, advertisement or joint promotion. However we will act on feedback from our customers if any of these parties act in a misleading, unethical or illegal manner. Our main concern is that of our customers, and that they receive the quality and security they expected from CoffeeZone. If this is not given by any of the parties that we are involved with, then we will reassess our current position in the interest of our loyal customers.

As a customer we would expect that if such an issue arises then you should contact CoffeeZone so that we can investigate the situation. Also note as a consumer you still have your rights as stated by Government legislation. We also would expect that we are given the benefit of doubt until we have had time to assess the relevant situation.


Copyright, Ownership and Title

Copyright, ownership and title on the CoffeeZone website are owned by Zanbil Enterprises P/L and CoffeeZone. If otherwise, it will be stated where relevant and so will the relevant party to that copyright, ownership and title. The individual manufactures, distributors and entities own their respective logos, pictures, intellectually property and all associated ownership rights.

CoffeeZone issues permission to use information in "The Zone" section for personal use. However no part of the website may be used for profiteering. Sections of "The Zone" may be printed out for personal use but not replicated without the written permission of Zanbil Enterprises P/L and CoffeeZone.


Viruses and Infected Files

CoffeeZone will do all in its power to ensure that any emails and other files transmitted to customers are free from Viruses and infected files. However due to the nature of the technology and the forces that are against the industry globally, CoffeeZone will not be liable to the customer, company or any other person or entity for damage, loss - whether financial, consequential, economic, direct, indirect or other, no matter the cause and whether through negligence or other, that may be caused either directly, indirectly or other from viruses or infected files. We also make no claim that our website, and files attached to our website is free of viruses and infected files, and thus take no responsibility or liability for third parties that have links, advertisements or joint ventures with CoffeeZone.

It is the full responsibility of the customer and recipient to ensure that adequate virus protection, detection and eradication software is being used. It is your responsibility to scan any and all files from CoffeeZone.

Our liability will be limited to only the cost of resupplying you with the information again, if you so require. 


Indemnity

The CoffeeZone website has been developed in good faith and governed by laws set by the NSW Government and the Australian Federal Government. You as a customer agree to indemnify in all manners all those associated with CoffeeZone and the CoffeeZone website, whether directly, indirectly, third party or other, from all forms of liability, costs and other in relation to meeting its obligations within this agreement and any implied agreement.

You will also indemnify CoffeeZone from any actions through an associated third party for any breaches on their own agreement or Government laws they are expected to adhere to.


All manufacturer warranties must be dealt with the individual manufacturer/distributor and not CoffeeZone. We will however refund any faulty or unwanted products providing they are within the limitations set out in the Refund Policy in this agreement. Once they fall outside the limitations, the customer must deal with the manufacturer/distributor directly, however CoffeeZone will provide assistance where possible if some situations cannot be resolved directly with the manufacturer/distributor.

However your rights as a consumer are still protected under the relevant laws as set by the appropriate governments in the relevant States and Territories.


Disclaimer

The CoffeeZone website has been developed in good faith and on an "as is" basis and the information within the website or correspondence sent by CoffeeZone is current at the time the information was placed on the website or sent to the customer.

We also do not imply that the website will be free of errors, mistakes, omissions and accuracy. CoffeeZone will endeavour to ensure that this is limited but concedes that this may happen from time to time. There may also be times due to unforseen circumstances or machinery failure whether directly, indirectly or third party, that the website may experience difficulties operating at its optimum levels. This may affect transmission, ordering, emailing, security and other. 


Privacy Policy 

CoffeeZone will construct a database of its' customers for its' own internal use. CoffeeZone will not sell, distribute or discuss details of CoffeeZones' clients. However if there is a situation where CoffeeZone is conducting a joint promotion with another company, then some details may be used in this promotion. 

If you do not wish to have part or all of your details used in a joint promotion please indicate this on the order form when ordering your products from CoffeeZone website or via fax or phone when placing your order.
